Terms of Service
These Terms of Service ("Terms") govern your access to and use of Nooshi.ai (the "Service"), operated by PaliAnalytics LLC, an Illinois limited liability company ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Nooshi.ai is a competitive-intelligence tool for independent restaurants. We collect publicly available information about restaurants near a location you provide, generate weekly reports and social-media drafts, and deliver them via email and an online dashboard. The Service is provided on an ongoing subscription basis.
2. Account and eligibility
You must be at least 18 years old and legally authorized to bind the business you are signing up on behalf of. You are responsible for the accuracy of the information you provide (business name, address, email) and for maintaining the confidentiality of your account credentials. Notify us at support@nooshi.ai if you believe your account has been compromised.
3. Subscriptions, trials, and billing
The Service is available as a monthly subscription for $29 USD per month. New accounts receive a 7-day free trial. A valid payment method is required to start the trial. Your card will not be charged until day 8, unless you cancel first.
Subscriptions renew automatically each month at the then-current price until you cancel. You may cancel at any time from your billing portal, accessible from your dashboard. Cancellation takes effect at the end of the current billing period; you retain access until that date.
Payment processing is handled by Stripe. We do not store your full card number. Applicable sales tax is calculated automatically by Stripe based on your billing address.
4. Refunds
We do not offer refunds for partial billing periods. If you cancel mid-month, you will retain access until the end of the paid period and will not be charged again. If you believe you were billed in error, contact us at support@nooshi.ai within 14 days and we will review.
5. Acceptable use
You agree not to:
- Use the Service to violate any law, regulation, or third-party right;
- Attempt to reverse-engineer, scrape, or resell the Service or its data;
- Impersonate another business or misrepresent your identity;
- Use the Service to send spam, harass, or defame others;
- Interfere with the Service's operation, security, or availability.
We may suspend or terminate accounts that violate these rules, without notice or refund.
6. Data ownership
You own the information you provide about your own business. The competitive-intelligence data, reports, and social-media drafts we generate for you are licensed to you for your business use for as long as your subscription is active. Aggregated, anonymized usage statistics (e.g., "our average customer has 8 competitors within 2 miles") may be used by us for product research and marketing.
7. Third-party data and AI-generated content
Nooshi surfaces publicly available data from third-party sources (including Google, restaurant websites, and delivery platforms) and uses AI models to generate summaries, briefs, and social-media drafts. We do not guarantee that this data is complete, current, or accurate, and you are responsible for reviewing any AI-generated content before acting on it or publishing it. You should not treat outputs as legal, financial, or business advice.
8. Intellectual property
The Nooshi.ai brand, software, design, and underlying technology are the property of PaliAnalytics LLC and are protected by copyright, trademark, and other laws. Nothing in these Terms transfers ownership of the Service to you.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that the outputs will improve your business performance.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PALIANALYTICS LLC, ITS OFFICERS, AND ITS AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. Our aggregate liability for any claim arising out of these Terms or the Service is limited to the amount you paid us in the twelve months preceding the claim.
11. Termination
You may terminate your account at any time by canceling your subscription. We may suspend or terminate your account if you breach these Terms or if we discontinue the Service. Upon termination, your right to use the Service ends immediately. Sections 6 through 13 survive termination.
12. Governing law and disputes
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved exclusively in the state or federal courts located in Cook County, Illinois, and you consent to the jurisdiction of those courts.
13. Changes
We may update these Terms from time to time. Material changes will be communicated by email or dashboard notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
